Yet, as the one-year deadline for federal agencies to finalize rules passed this Saturday, not a single regulation was complete, leaving issuers to navigate a landscape of uncertainty.

The failure to meet the statutory deadline reveals a fundamental disconnect in Washington. While the law’s effective date of January 18, 2027, remains firmly in place, the window for firms to align their operations with final federal standards is rapidly shrinking. Instead of concrete rules, the Treasury, OCC, FDIC, and other agencies have produced a stack of ten proposals, several of which remain subject to comment periods that extend well beyond the original mandate. This delay creates a precarious environment where issuers must either gamble on building against draft rules or risk a frantic, costly compliance sprint once final texts are eventually released.

Institutional players are already maneuvering within the regulatory fog. BlackRock, for instance, has pressured the OCC to drop a potential 20% cap on tokenized reserve assets, aiming to solidify the role of its BUIDL fund within stablecoin baskets. Meanwhile, the lack of a finalized 'substantially similar' test for state-level oversight leaves smaller issuers in limbo, unable to determine if their current domiciles will satisfy federal standards. By prioritizing bureaucratic process over the law’s intended schedule, regulators have inadvertently created a moat for incumbents, while offshore competitors continue to operate without the looming burden of American compliance costs. The GENIUS Act was designed to provide the industry with a definitive operating manual; one year later, the market is still waiting for the first page.
