New York state officials have launched a sweeping legal offensive against prediction market platform Kalshi, seeking to halt its operations and recover at least $36 billion in penalties. The lawsuit accuses the company of bypassing state licensing requirements and allowing minors to participate in high-risk, unlicensed gambling activities.

Attorney General Letitia James filed the complaint on Friday, arguing that Kalshi’s event contracts—covering sports, elections, and cultural milestones—constitute illegal gambling rather than federally regulated derivatives. Governor Kathy Hochul emphasized that the state’s gaming laws are designed to protect consumers and prevent addiction, asserting that the platform has ignored these mandates to prioritize growth over legal compliance.

Beyond the financial penalties, which include restitution for users and treble damages, the state is seeking a temporary restraining order to immediately block Kalshi’s offerings. This move intensifies a broader jurisdictional clash, as Kalshi maintains that its federal registration under the Commodity Futures Trading Commission should shield it from state-level enforcement. While a federal judge recently refused to grant Kalshi emergency relief against New York's efforts, the company continues to challenge the state's authority in the Second Circuit. The outcome of this dispute remains uncertain as courts across the country reach conflicting conclusions on whether federal commodity laws preempt state gambling regulations.
