Unless a cloture petition is filed by Wednesday, the window for floor action before the August 10 recess effectively closes.

The Senate’s current agenda is dominated by a spending bill, specifically a continuing resolution under H.R. 6500, with no formal mention of H.R. 3633. Under standard Senate Rule XXII, a cloture motion filed by Wednesday, August 5, would allow for a procedural vote on Friday, August 7. This vote would not determine the bill’s passage but would decide whether the chamber ends debate on the motion to proceed.

Securing the necessary 60 votes remains a high hurdle, as Republicans currently hold 53 seats. Seven Democratic senators—Catherine Cortez Masto, Angela Alsobrooks, Cory Booker, Ruben Gallego, John Hickenlooper, Mark Warner, and Raphael Warnock—have publicly questioned the current draft, citing concerns over ethics, consumer protections, and market integrity. Senator Elizabeth Warren has been more forceful, labeling the legislation dead on arrival, though Senator Cynthia Lummis maintains that negotiations are ongoing. While faster procedural routes exist, they require broad bipartisan cooperation that has yet to materialize. With the chamber set to begin a work period from August 10 through September 11, any delay forces the debate into an increasingly crowded autumn calendar, heightening the political stakes as the 2026 midterms approach.
