Tribunal Upholds Ban on Hedge Fund Founder Crispin Odey

London’s Upper Tribunal has affirmed a permanent ban on Crispin Odey from the financial industry, rejecting the hedge fund founder’s appeal against regulatory sanctions. While the court maintained the disqualification, it trimmed the Financial Conduct Authority’s initial fine by roughly £300,000, bringing the total penalty to just under £1.53 million.

The ruling concludes a protracted legal battle involving the FCA and the veteran financier, who gained notoriety for his lucrative short-selling positions during the 2008 financial crisis. Regulators moved to bar Odey after determining he deliberately obstructed an internal investigation into sexual misconduct allegations at Odey Asset Management. The tribunal found that Odey weaponized his authority as the firm's controller to dissolve executive committees twice in 2021 and 2022, specifically to shield his own interests from scrutiny.

During proceedings, the panel rejected Odey’s defense that his actions were necessary to protect the firm from an existential threat. Instead, the tribunal noted a distinct lack of integrity in his management style. Therese Chambers, the FCA’s executive director of enforcement, highlighted that throughout the hearing, Odey characterized himself as a victim while failing to express remorse for his conduct. Although the former manager admitted to a 2005 incident involving the non-consensual groping of a woman, he has consistently denied broader allegations of sexual assault and harassment. This decision serves as a significant milestone for the FCA’s aggressive push to enforce higher standards of workplace conduct across the City of London.
