As the U.S. Senate rejected the CLARITY Act on September 15, Ripple CEO Brad Garlinghouse signaled that the long-term trajectory of cryptocurrency remains tied to technological performance rather than federal statute. Despite the bill’s failure to clear a 60-vote threshold, industry leaders argue that crypto adoption will persist regardless of current regulatory gridlock.

Speaking at an Economic Club of Kansas City event, Garlinghouse emphasized that superior, faster, and more efficient technology typically wins in the marketplace. While Ripple remains a vocal advocate for federal market-structure legislation, the executive maintained that the industry’s growth is a technological question that extends beyond the outcome of any single congressional bill. His remarks came as the Senate blocked H.R. 3633 in a 49-50 vote, effectively stalling the proposed division of oversight between the SEC and the CFTC.

Following the legislative stalemate, Ripple issued a formal statement affirming that its business operations and the regulatory status of XRP remain unchanged. The company points to existing federal guidance, which classifies XRP as a digital commodity, as the current bedrock for its U.S. presence. While the failed cloture motion—which saw Republican senators like Thom Tillis switch to a ‘no’ vote—leaves a legislative void, SEC and CFTC officials are now under increased pressure to utilize their existing authority to provide market clarity. As markets reacted to the vote, Bitcoin dropped over 5% and shares of companies like Coinbase and Circle faced sharp declines, reflecting investor anxiety over the uncertain regulatory path ahead.
