Despite the 49-50 vote leaving the bill short of the 60-vote threshold, the group insists the effort is not dead, even as broader legislative gridlock persists.

The failed cloture vote on Sept. 15 highlighted deep divisions over ethics provisions, including proposed restrictions on lawmakers trading digital assets. Sens. Kirsten Gillibrand, Angela Alsobrooks, Cory Booker, Catherine Cortez Masto, Ruben Gallego, Mark Warner, and Raphael Warnock spearheaded the opposition, though they now signal a commitment to bipartisan revisions.

Industry experts suggest that even if the bill were to pass, it would not serve as a panacea for crypto firms. Coinme CEO Neil Bergquist noted that the legislation would clarify federal oversight between the SEC and the CFTC but would leave state-level money-transmitter licenses entirely untouched. Platforms would remain tethered to dual layers of compliance, continuing to navigate a fragmented regulatory landscape where agencies often rely on enforcement actions rather than clear, durable statutes. With the midterm elections looming and a packed Senate calendar, analysts expect the focus to shift back to agency-led rulemaking, which remains vulnerable to reversal by future administrations.
