CFTC Moves to Classify Event Contracts as Swaps

The Commodity Futures Trading Commission has officially proposed bringing sports, political, and weather event contracts under its swap definition, a move designed to assert federal authority while simultaneously carving out a formal exclusion for casino-style gambling products to clarify the boundaries of state-level gaming oversight.

CFTC Moves to Classify Event Contracts as Swaps

The October 9 proposal aims to resolve long-standing ambiguity under the Commodity Exchange Act by categorizing contracts tied to specific future outcomes as financial derivatives. According to CFTC Chairman Michael Selig, these instruments allow participants to hedge risks and speculate on events with potential economic consequences. While the agency seeks to consolidate its regulatory grip on prediction markets, it has issued an interim final rule explicitly exempting sportsbook wagers and casino games, labeling them outside the scope of federal derivatives regulation.

This regulatory push arrives amid a fractured legal landscape. Federal appeals courts remain divided on whether CFTC registration grants platforms immunity from state gambling laws. While the Third Circuit previously shielded Kalshi from New Jersey’s enforcement efforts, the Sixth and Ninth Circuits have allowed states to maintain their grip on local gaming rules. The NFL has now intervened at the Supreme Court level, supporting New Jersey’s request for a definitive ruling. The league argues that state oversight is vital to maintain game integrity and protect consumers, particularly as betting volumes on sports-related prediction markets continue to climb. With the CFTC accepting public comments for the next 30 days, the industry faces a pivotal transition that could redefine the legality of betting on real-world events.
