The CLARITY Act, which passed the House with a 294-134 vote and cleared the Senate Banking Committee 15-9, faces a high hurdle in the upper chamber. To move toward a floor debate, supporters must secure 60 votes. With Republicans holding 53 seats, the measure requires bipartisan cooperation from at least seven Democrats. Armstrong maintains that statutory clarity provides a necessary defense against government overreach, noting that federal laws offer more permanence than agency-level enforcement actions, which can be reversed by changing administrations.

Beyond the political maneuvering, the bill seeks to bifurcate oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission. By establishing formal definitions for digital commodities and network tokens, the framework aims to standardize registration, disclosure, and insolvency protocols. While Armstrong frames the legislation as a safeguard against catastrophic failures like FTX, critics point out that statutory requirements cannot fully eliminate the risks of fraud. As the Senate prepares for the September 15 vote, uncertainty remains regarding agency alternatives; while Armstrong has pointed to potential SEC and CFTC action on September 16, neither regulator has finalized a rule package that could serve as a comprehensive substitute for congressional action.
